The Consumer Rights Protection Centre (PTAC) has found that shopping centres have decorations in the form of Christmas trees with empty bottles of Jameson whiskey and offering discounts on this brand of alcoholic beverages, which encourages consumers to purchase alcohol and is illegal, according to PTAC.

The centre explained that in this case, the Christmas decorations – tree stands made from empty Jameson whiskey bottles, in the context of the Jameson whiskey promotions – are aimed at promoting the sale of specific products and indicate a violation of the prohibition set out in the Alcoholic Beverages Circulation Law.

In view of the above, the PTAC calls on shopping centres and retail chains to immediately remedy the violations by no longer displaying such decorations on their premises.

The PTAC noted that, in accordance with Section 11, Paragraph 5 of the Alcoholic Beverages Circulation Law, advertising the prices and discounts of alcoholic beverages is prohibited. In turn, Section 11(7) of the aforementioned law prohibits the implementation of measures to promote the sale of alcoholic beverages in retail outlets.

The PTAC pointed out that it has the right to impose a fine of up to €14,000 for non-compliance with advertising requirements, while for non-compliance with the prohibition on sales promotion measures set out in the Alcoholic Beverages Circulation Law, the PTAC has the right to impose a fine of up to EUR 30,000.
